% 11.03.2019 IA 3539/2019 Exemption allowed subject to all just exceptions. Arb.P. 166/2019 This petition under Section 11 of the Arbitration and Conciliation Act, 1996 has been filed by the petitioner seeking appointment of an Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the Buyer's Agreement dated 07.12.2012 executed between the parties. Clause 17 of the said Agreement states that the arbitration proceedings shall be held at Gurgaon. Clause 18 of the Agreement further specifies that the Agreement shall be subject to sole jurisdiction of the Courts at Gurgaon, Haryana.

In view of the above Clauses of the Agreement vesting exclusive jurisdiction in the Courts at Gurgaon, Haryana, this Court would lack territorial jurisdiction to entertain the present petition. The petition is accordingly dismissed granting liberty to the

petitioner to approach the competent Court.
