Learned counsel for the respondent nos. 1 and 4 submits that sale deed dated 08.08.2005 executed by the respondent no.1/ defendant no.1 registered on 09.08.2005 in favour of the respondent nos. 3 & 4/ defendant nos. 3 & 4, unregistered agreement to sell dated 12.08.2005 executed by respondent no.3/defendant no.3 in favour of respondent no.1/ defendant no.1 are in his possession, the photocopy of which he shall place before the learned Trial Court tomorrow i.e. on 13.03.2024 and the originals shall be produced as and when directed by the learned Trial Court. However, learned counsel further submits that registered G.P.A dated 12.08.2005, affidavit, will dated 24.08.2003 and receipt dated 12.08.2005 are not in possession of respondent nos. 1 and 4.

Learned counsel for the petitioner in these circumstances submits that present petition be disposed of.

In view of the undertaking given by the respondent nos. 1 and 4 to produce the photocopy of the aforesaid documents before the learned Trial Court tomorrow i.e. on 13.03.2024, and having considered the above submissions, present petition stands disposed of with aforesaid observations.
