O R D E R

The present petition has been filed by the petitioner seeking that the respondent be directed to refund the pending payment to the petitioner qua the products returned by the petitioner at the time of handing over the charge of the Mother Dairy Booth-693, situated at D-Block, Near Police Station, Mangolpuri, North West, Delhi- 110083.

The petitioner herein is the ex-concessionaire of the said booth which was allotted to him in the year 2020. The petitioner's agreement with the concerned respondent qua the said booth, expired on efflux of time. The petitioner filed a Writ Petition No. 10619/2024, seeking to interdict the respondents from taking charge of the Mother Dairy Booth and also seeking that representation/s of the petitioner be decided. Although direction/s were issued to consider the representation of the petitioner, the said exercise did not culminate into any extension being granted to the petitioner. Consequently, the charge of the concerned booth was handed over by the petitioner to the respondents.

The petitioner is aggrieved on account of alleged deficiency in terminal payment/s and/or refund/s due to the petitioner. It is submitted that the petitioner has made a representation on 07.03.2025 in this regard to the respondent.

After some hearing, learned counsel for the petitioner confines himself to seeking that any competent officer of the respondents be directed to decide the aforesaid representation of the petitioner and carry out the reconciliation exercise to determine the outstanding payment, if any, payable to the petitioner. The said request is not opposed by the learned counsel for the respondents.

Accordingly, the present petition is disposed of with a direction to the respondent to depute a responsible officer to decide the aforesaid representation of the petitioner and carry out a financial reconciliation exercise, after taking into account the version of the petitioner. Let the said exercise be completed within a period of 8 weeks from today. 7.
With the aforesaid directions, the present petition is disposed of. 8.
Needless to say, if the petitioner is aggrieved by the outcome of the aforesaid exercise, he shall be at liberty to avail appropriate remedies as may be available under law.
