The present writ petition under Articles 226 and 227 of the Constitution of India seeks to assail the order dated 08.01.2024 passed by the learned Central Administrative Tribunal in O.A. 1865/2022. Vide the impugned order, the learned Tribunal has rejected the petitioners' original application wherein they had sought directions to the respondents to pay them salary w.e.f. November 2021.

claim has been rejected by the learned Tribunal after observing that once their services already stood terminated they could not claim any salary. 5.

After some arguments, learned counsel for the petitioners concedes that the termination order has not been assailed by the petitioners. He, therefore, seeks leave to withdraw the present petition with liberty to assail the termination order dated 19.04.2023, as per law. 6.

Learned counsel for the respondents has no objection to this limited request being made.

The petition is, accordingly, disposed of as not pressed with liberty as prayed for.

It is, however, made clear that this Court has not expressed any opinion on the merits of the petitioners' claim or regarding the validity of the termination order, which the petitioners propose to assail.
