O R D E R

Vide the present petition under Section 439 Cr.P.C., the petitioner seeks regular bail in FIR No.239/2019 under Sections 307/354/201/34 IPC PS Shahdara, Delhi registered on 21.09.2018. 2.

The petitioner is a 23 year old young man who has been in custody since 31.01.2020.

The allegations in the FIR pertain to an incident, wherein it has been alleged that the petitioner's father had with the help of some young boys assaulted the complainant and his wife on account of a petty fight arising out of the complainant feeding street dogs. The petitioner is the son of the main accused namely Shri Surinder Verma, but has not been named in the FIR even though he is stated to be well known to the complainant, on account of them being

neighbours.

The main accused Shri Surinder Verma, who is the father of the petitioner has been already released on bail vide order dated 30.04.2020 and there is no complaint that after his release, he has tried to, in any manner, contact the prosecution witnesses or tamper with the evidence.

In these circumstances, without commenting on the merits of the case, I am of the view the petitioner has made out a case for being released on bail.

Accordingly, it is directed that the petitioner be released on bail subject to his furnishing a personal bond in the sum of Rs.25,000/- to the satisfaction of the Jail Superintendent. The petitioner will not leave the NCR without the prior permission of the learned Trial Court and will not try to contact any of the witnesses or hamper the trial in any manner.

The petitioner will also furnish a mobile number to the SHO, P.S. Shahdara and will continue to report to him by a message/whatsapp message once a week and report to the concerned SHO, as and when required. The aforesaid mobile number will be kept operational at all times.

In view of the ongoing nationwide lockdown, the Jail Superintendent is directed to ensure that a vehicle is arranged to drop the applicant at his residence.

Needless to state that the observations made hereinabove are only prima facie, and will not have a bearing on the trial. 7.

The bail application is disposed of in the above terms.
