% 16.08.2018 Learned counsel for defendant No.4 says that he is not able to produce the witness, who is presently in USA and would not come to India in the near future. In the circumstances, the right to lead evidence of defendant No.4 stands closed.
Learned counsels say per para 38 of the plaint the valuation of the properties to be partitioned is approximately Rs.1.42 crores and hence the matter need to be sent to the District Court. In the circumstances, the file be sent complete in all respect to the District Judge (West), Tis Hazari, Delhi through the registry and parties to appear before the District Judge (West), Tis Hazari, Delhi on 14th September, 2018.
