The present petition under Articles 226/227 of the Constitution of India, 1950, read with Public Premises (Eviction of Unauthorised Occupants) Rules, 1971, and further read with Rule 40(iv) of the Central Govt. General Pool Residential Accommodation Rules, 2017, seeks the following prayers: - "a) Set-aside the eviction order dated 28. 12.2023, passed by respondent No.1 and order dated 02.04.2026, passed by Ld. Principal District & Sessions Judge (Central), Tis Hazari Courts, Delhi in PPA No.03/2024 titled as Dhara Singh Vs. Estate Officer &s Anr. and direct the respondents to restore the allotment of Quarter No.607, Block-Z, Timarpur, Delhi110054 to the LRs of deceased petitioner, in the interest of justice. b) Pass any other order(s)/relief(s), which this Hon'ble Court deems fit and proper in favour of the petitioner and against the respondents, in the interest of justice."

On the last date of hearing, i.e., 06.04.2026, while issuing notice in the present petition, this Court had passed the following order by observing as under: - "4. During the course of arguments, learned counsel for the petitioner submits that the latter may be given reasonable time to vacate the subject premises.

5. On the aforesaid limited issue, on the petitioner taking necessary steps, issue notice to the respondents, through all permissible modes, including electronic mail, if any, returnable on 24.04.2026.

6. In the meantime, no coercive steps be taken against the petitioner till the next date of hearing."

Learned counsel appearing on behalf of the petitioner(s) submits that the latter does not wish to press the present petition, and shall vacate the subject premises on or before 31.07.2026, and in view of the same, he seeks leave to withdraw the present petition.

Leave granted.

The present petition is dismissed as withdrawn and disposed of accordingly.

Pending application(s), if any, also stand disposed of. 8.

Interim protection granted vide order dated 06.04.2026 shall continue till 31.07.2026.

Needless to state that the petitioner shall abide by the undertaking given before this Court. In case of non-compliance, the respondent is at liberty to take necessary action or initiate appropriate proceedings in accordance with law.
