By way of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks regular bail in connection with FIR No. 187/2025, dated 28.06.2025, registered under Sections 137(2)/309(4)/309(6)/3(5) of the Bharatiya Nyaya Sanhita, 2023, at Police Station Laxmi Nagar, District East, Delhi. 2.

Ms. Manjeet Arya, learned Additional Public Prosecutor, has handed up a status report, which is taken on record. She submits that charges have already been framed and the matter is presently at the stage of prosecution evidence. However, the complainant has not yet appeared for the purpose of recording of evidence.

applicant`, seeks permission to withdraw the present application, without prejudice to the applicant's right to approach the learned Sessions Court at an appropriate stage.

However, Mr. Rana submits that the complainant has failed to appear on two dates fixed for the recording of evidence. He, therefore, seeks appropriate directions in this regard to ensure the presence of the complainant. Ms. Arya submits that the prosecution shall take all necessary steps to secure the presence of the complainant before the learned Sessions Court on the next date of hearing, and assures the Court that no unnecessary adjournments shall be sought on behalf of the prosecution.

The application for regular bail, alongwith the pending application, is accordingly dismissed as withdrawn, in terms of the above submission. It is, however, made clear that the applicant shall be at liberty to approach the learned Trial Court at an appropriate stage, including in the event of any inordinate delay in the recording of evidence of material witnesses. 6.

It is further clarified that this Court has not expressed any opinion on the merits of the case, and all rights and contentions of the parties are kept open.
