Heard the learned Counsel for the Parties.

After arguing at some length, the learned Counsel for the Appellant prays that the Appellant may be permitted to withdraw the present Appeal with liberty to institute appropriate proceedings before a Court of competent civil jurisdiction for claiming the relief of compensation. 3.
Accordingly, the Appeal is hereby dismissed as withdrawn with liberty as prayed for.

competent civil jurisdiction, the same may be expedited and decided in accordance with law. We further provide that if any such civil proceedings are instituted, the same shall be decided by the Court concerned without being influenced by the judgment dated 15.12.2025 ("Impugned Judgment") rendered by the learned Single Judge in W.P.(C) No. 16113/2025.

We also direct that the Impugned Judgment passed by learned Single Judge will have no bearing so far as the investigation of the criminal case is concerned.
