Mr. Baljeet Singh, Sr. Manager of the respondent-bank at Sarvpriya Vihar Branch, New Delhi is present in person. Photocopy of his identification is filed in Court. He states that indeed there is a settlement whereby the respondent-bank has received in full and final satisfaction of its claim the amount from the appellant in terms of the letter dated 21.12.2018 of the appellant. It is accordingly stated that all disputes between the parties have been finally settled.

In view of the aforesaid position, this application is allowed and

the appeal is disposed of in view of the settlement already entered into between the parties. Whatever amount has been deposited by the appellant in this Court, alongwith accrued interest, be refunded back to the appellant by the Registry of this Court within a period of four weeks from today.
