CRL.M.C. 1021/2020 & CRL.M.A.4116/2020 (for stay) By the present petition, petitioner has challenged the order dated 10.10.2019 passed by learned MM-02, PHC, New Delhi whereby crossexamination of AR for complainant was closed. A perusal of order dated 10.10.2019 shows that it is an admitted fact that on previous date, i.e. 24.5.2019, an adjournment was sought for crossexamination of AR of complainant and last and final opportunity was granted to petitioner for the said purpose.

On 10.10.2019, again an adjournment was sought which was declined by recording that as last and final opportunity for cross-examination of AR of complainant had already been given on previous date of hearing, i.e. on

24.5.2019, accordingly, cross-examination of said witness was closed. Keeping in view reasons stated in the present petition and in the interest of justice, I hereby set aside order dated 10.10.2019 subject to cost of Rs.20,000/- and out of which Rs.10,000/- shall be deposited in Delhi Police Martyrs Fund and Rs.10,000/- shall be paid to respondent. The present petition is, accordingly, allowed and disposed of. Pending application also stands disposed of.
