IN THE HIGH COURT OF DELHI AT NEW DELHI

+ BAIL APPLN. 561/2020 & Crl. M.A. 4263/2020 KAVITENDER KUMAR @ SANTOSH ANAND ..... Petitioner Through:

Mr. Manish Sangwan, Adv.

versus STATE ..... Respondent Through:

Mr. Amit Ahlawat, APP for the State with SI Mohit Asiwal, P.S.I.P.Estate.

CORAM:

HON'BLE MR. JUSTICE RAJNISH BHATNAGAR

O R D E R

% 26.02.2020 1.

It is submitted by learned APP for the State, on instructions from the IO, that petitioner has not come to this Court with clean hands and he has suppressed the facts that bail application has been moved before the Sessions Court, which is listed today and adjournment has been sought by the counsel for the accused and the bail application is now fixed for 4.3.2020 before the Sessions court. 2.

Learned counsel for the petitioner submits that he is not aware of this fact that a similar bail application is pending before the Sessions Court. I am unable to believe the counsel for the petitioner because record reveals that somebody on behalf of the petitioner is repeatedly pursuing the bail proceedings, and time and again bail applications are being filed.

3.

Counsel for the petitioner wishes to withdraw the bail application.

4.

The bail application is dismissed as withdrawn subject to deposit of costs of Rs.25,000/- with the Delhi High Court Legal Services Committee.
