% 11.03.2019 The petitioner is facing trial in case arising out of FIR no. 245/2018 of police station Pandav Nagar involving offences punishable under Sections 376(2)(n), 323 and 506 IPC, as framed on 16.10.2018. Going by the allegations in the charge-sheet, it appears prosecution had been sought inter alia on the allegations of gang rape punishable under Section 376 D IPC. Neither side seems to be clear as to why charge was not framed under Section 376D IPC. The copy of the order framing charge will have to be seen.

The petitioner is directed to file all the necessary documents. The State will also file a report in this regard. Be listed on 12th April, 2019.
