This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- "(a) issue writ of certiorari and/or any other writ, order or direction quashing the impugned communications dated 03.04.2025 and 05.04.2025, whereby the Petitioner's admission under the EWS/DG category was arbitrarily threatended to be discontinued;

(b) Issue a writ of mandamus or any other appropriate writ, order, or direction directing Respondent No. 1 (Directorate of Education) and Respondent No.2 (Lilawati Vidya Mandir Sr. Sec. academic session 2026-27 and to extend all benefits admissible under the EWS/DG category;

(c) Pass interim orders directing Respondent No.2 to allow the Petitioner to attend classes during the pendency of the present writ petition; . . ."

The case of the petitioner is that the petitioner, a minor through natural guardian and father, belongs to Disadvantaged Group (DG) category and took admission in respondent No. 2 School to the Nursery class in the academic session 2022-23. Subsequently, the petitioner has now been promoted to Class III. 3.

However, the respondent No.2 school vide letter dated 03.04.2025 informed the petitioner that respondent No.1 has discontinued the entitlement benefits under the EWS / DG category and further vide letter dated 05.04.2025 also informed the petitioner that the admission of the petitioner under the EWS/DG category has been rejected by respondent No. 1.

However, no adverse actions were taken during academic session 2025-26 and on 30.03.2026, upon successful completion of Class II, petitioner was duly promoted to Class III and was also issued books. 5.

However, on 01.04.2026, the father of the petitioner was told to not send his ward to school anymore. On 02.04.2026, petitioner was not allowed to attend classes and her parents were told not to send her to school.

Hence, the present petition.

For the said reasons, issue notice.

respondent No.1 and states that the petitioner had not made any representation to the respondent No.1 in this regard. She states that the present petition will be treated as a representation and appropriate action shall be taken.

Taking Ms. Sachdeva's, learned counsel for respondent No.1, statement on record, the present petition is disposed of with the following directions:- i.

The petition shall be treated as representation to the respondent No.1 and the respondent No.1 shall pass a speaking order expeditiously and not later than 15 days from today. ii.

Since the petitioner was not permitted to attend classes presumably on account of lack of OBC certificate and the OBC certificate of the petitioner as well as the father is annexed with the petition, it is directed that till the speaking order is passed the petitioner shall be permitted to attend classes. The Directorate of Education ("DoE") shall ensure compliance.

iii.

The DoE shall also ensure that the uniform and books are supplied to the petitioner, if entitled, in accordance with Rule 8 of the Delhi Right of Children to Free and Compulsory Education Rules, 2011.
