An application under Section 439 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner for grant of regular bail in FIR No. 0225/2016, under Sections 364A/392/394/397/506/34 IPC, registered at P.S.: Anand Vihar. Chargesheet has been filed under Sections 364A/394/395/397/506/412/34 IPC and Sections 25/27 Arms Act, registered at P.S.: Anand Vihar.

Learned counsel for petitioner submits that petitioner is in custody since 05.06.2016 for a period of about 08 years and completion of trial is likely to take time. He further submits that all other accused are on bail and the case of petitioner is at parity.

Learned APP for the State opposes the application on the ground that petitioner is involved in other offences and had played an active role in the commission of offence.

On the face of record, offence was committed in furtherance of common intention. Petitioner has already undergone imprisonment for a period of more than 08 years and conclusion of the trial is likely to take some time, since some of the witnesses are yet to be examined by the learned Trial Court. Co-accused Anuj @ Annu has been released on bail vide order dated 16.10.2023 passed in BAIL APPLN. 3210/2023 by Co-ordinate Bench of this Court. Keeping in perspective that the role of petitioner is at parity with the co-accused since the offence was committed in furtherance of common intention, he is admitted to bail on furnishing personal bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount to the satisfaction of the learned Trial Court and subject to following conditions:
(i) Petitioner shall appear before the learned Trial Court as and when directed;
(ii) Petitioner shall share his mobile number with the SHO/Investigating Officer concerned and shall not change the same without prior intimation to the IO/SHO concerned; (iii) Petitioner shall not indulge in any criminal activity or influence the witnesses in any manner.
Application is accordingly disposed of.
