This petition has been filed under Article 226 of the Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, for production of Ms. Nisha Khatun, the respondent no.3, who is claimed to be more than 18 years of age and therefore, a major.

On advance notice of this petition, Ms. Nisha Khatun has appeared before us virtually.

The learned Standing Counsel for respondent nos. 1 and 2 submits that she is presently lodged in Nari Niketan, Bapun Ghar, Bhagwan Das Road, New Delhi, as she was expressing threats from her family.

The learned counsel for the petitioner has handed over the copy of the Aadhar Card as also the high school tenth class examination result/mark sheet bearing the date of birth of Ms. Nisha Khatun which prima facie shows her to be major.

The Respondent nos. 1 and 2 shall have the same verified and if the verification report reveals her to be a major, it will be her wish that will decide where she wishes to reside.

Further action in this regard shall be taken by the Respondent No.1 and 2 on the basis of the verification so carried out. 7.
The petition, along with pending application, if any, stands disposed of in terms of the above directions.
