W. P. (Crl.) 724/019 By the present writ petition filed under Article 226 of the Constitution of India read with Section 482 Cr.PC, the petitioners seek a writ of mandamus or a direction to the respondent No. 1 to investigate their complaint and register an FIR against the respondent No. 2 under the relevant Sections of the Indian Penal Code.

Learned counsel for the petitioners submits that respondent No. 2 is their son in law and a marital discord has arisen between them. He further submits that on 23.02.2019, respondent No. 2 assaulted to the petitioners. The matter was reported to the police but police failed to take any appropriate action against the respondent No. 2. W.P.(CRL) 721/2019

Notice. Learned APP for the State accepts notice. Status report has been handed over in Court today. Learned APP for the State submits that as per the MLC report, the petitioners received minor injuries and an FIR No. 148 dated 09.03.2019 under Section 341/323 of the Indian Penal Code has already been registered at Police Station -Uttam Nagar and the matter is pending consideration. Learned APP for the State seeks time to file a fresh status report. List on 08.04.2019.
