The present Petition has been filed under Article 226 of the Constitution of India read with Section 82 of the Cr.P., 1973 with a prayer that the Petitioner be released pre maturely. 2.

Learned ASC appearing on behalf of the State has filed a copy of the Order of case bearing No. W.P.(CRL) 1438/2024 in the case of GHANSHYAM @ JAVED & ORS. V. STATE (GOVT. OF NCT OF DELHI) passed by the Coordinate Bench of this Court on 09.05.2024 wherein the present Petitioner along with four other accused had sought the quashing of the minutes SRB. The said Petition has been disposed of with the directions to the respondent to consider the case of the petitioners afresh with premature release in terms of the beneficiary policy applicable to the petitioner. The said copy of the Order is taken on record. 3.

Learned counsel for the petitioner seeks permission to withdraw the present Petition in view of this subsequent Petition.
