$~83 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 514/2016 MUTHU MEMORIAL EDUCATIONAL TRUST ..... Petitioner Through Mr.Mayank Manish with Mr.Ravi Kant, Advocates.

versus NATIONAL COUNCIL FOR TEACHER EDUCATION AND ANR ..... Respondents Through Mr.Anil Soni with Mr.Naginder Benipal, Advocates for R- 1 & 2.

CORAM:

HON'BLE MR. JUSTICE MANMOHAN

O R D E R

% 20.01.2016 The present writ petition has been filed challenging decision of respondents taken in 295th Meeting held between 28-30/11/2015 and 01/12/2015 whereby the petitioner's application for the M.Ed. Course and the B.Sc. BA/B.Ed. Integrated Course was rejected on the ground that NOC from the Tamil Nadu Teachers Education University had not been produced.

Petitioner further seeks to direct respondent-NCTE to permit the processing of the application of the petitioner for the aforesaid course keeping the final recognition pending until the issuance of NOC.

Learned counsel for the petitioner states that as per NCTE Regulations, there is one more option wherein the NCTE asks the State Government and its functionaries for their recommendations. Admittedly, the petitioner has not produced the NOC from Tamil Nadu Teachers Education University along with its application form, which it was statutorily bound to produce. The cut-off date for filing of application was 30th June, 2015.

Consequently, on the last date of submission of the application, the petitioner's application was not complete. Even till date, the petitioner has not challenged the non-furnishing of NOC by the Tamil Nadu Teachers Education University.

Accordingly, this Court finds no perversity or error apparent on the face of the record in the impugned order. The present writ petition is dismissed but with no order as to costs.
