The learned counsel for the petitioner, on instructions, submits that the present petition has become infructuous due to change in circumstances.

He seeks liberty to withdraw the present petition. 3.
It is not disputed by the learned counsel for the parties that the petition seeking maintenance under Section 125 of the Code of Criminal Procedure, 1973, has already been dismissed by the learned Family Court and, therefore, the respondent is not entitled for any amount unless she finally succeeds in the appeal challenging the said order.

In view of the above, the sum of ₹2,00,000/- deposited by the petitioner with the Registrar General of this Court pursuant to order dated 19.04.2023 is directed to be released in favour of the petitioner along with accrued interest, if any, on verifying his identity.
