% 30.07.2018 IA No. 9929/2018 (under Section 151 CPC filed by defendant no. 1 for de-sealing and return of original documents). The suit filed by plaintiff has already been dismissed in default and for non-prosecution.

The documents of defendant no. 1 as mentioned in para no. 3 of IA are reported to be lying in sealed condition and in safe custody. The applicant wants certified copy of said documents which can be provided only after de-sealing of the documents. He has also prayed for return of the original documents after taking certified copy of the same.

Considering the averments made in the application and as the original documents of defendant no. 1 are no more required by this

Court, the documents filed by defendant no. 1 which are reportedly lying in sealed cover are directed to be de-sealed. Certified copy of the documents after de-sealing may be obtained by applicant as per rules. Thereafter, the original documents as mentioned in para no. 2 of the IA be returned to applicant/defendant no. 2 as per rules. The applicant to appear before AR(Original) on 07.08.2018 at 3:00 p.m. for the purpose of de-sealing of the documents. IA stands disposed of accordingly.
