Plaintiff (petitioner herein) had filed a suit seeking recovery and during the pendency of the aforesaid suit, a notice under Section 340 Cr.P.C. (corresponding Section 379 of Bharatiya Nagarik Suraksha Sanhita, 2023) was issued to the petitioner bank and the bank has taken exception to order dated 29.02.2024.

Learned counsel for plaintiff/petitioner has, now, informed that there is material development in the matter and in view of the amicable settlement between the parties, plaintiff has withdrawn the aforesaid suit and even notice in question has been recalled. He, therefore, submits that nothing survives in the present matter and it can be, accordingly, disposed of. 3.

In view of the above, present petition is disposed of as having become infructuous.
