% 29.03.2019 Issue notice to the respondents.

Mr. Harpreet Singh, Senior Standing Counsel accepts notice on behalf of the custom authorities.

A limited claim in the petition is that the respondents have not provided the certified copy of an Order-In-Original dated 16.04.2018 by the Additional Commissioner and also not provided the copies of the show cause notice and the other documents relied upon. Besides that, stay of recovery is also sought.

Learned counsel for the respondents, at the outset, submits that

the certified copies of the Order-In-Original as well as the relevant documents including those relied upon and the show cause notice would be furnished to the petitioner. Learned counsel submits that the representative of the petitioner may appear before the Additional Commissioner on 01.04.2019 at 2:00 pm where the documents shall be provided by the respondents. The respondents are also restrained from taking any coercive action for a period of two weeks to enable the petitioner to seek the appellate remedy. The limitation in such a case would be reckoned from the date of supplying of the copies of the documents along with the copy of the Order-In-Original. The writ petition is disposed of in the above terms. The next date of 03.05.2019, already fixed in the writ petition, stands cancelled.
