Writ petitioner's objection concerning maintainability of the proceedings before the BIFR are pending consideration. Grievance is to the fact that for over 2 years matter is lingering on before BIFR. W.P.(C) 562/2016

Docket explosion choking Tribunals and Courts is there in India on account of less number of Courts and Tribunals in proportion to the litigation. Further compounded by not filling up vacancies on time. Thus delay in disposal of a proceeding would be no ground to entertain the instant writ petition.

It is hoped and expected that as and when BIFR becomes functional the pending proceedings before it concerning the writ petitioner would be expedited and objection to the maintainability decided within 3 months of the BIFR being functional.

Writ petition is dismissed.
