O R D E R

% 31.01.2017 At the outset, the learned counsel appearing for the respondent states that the respondent has already appointed Sh K.N. Aggarwal, Director General, CPWD as the sole arbitrator to adjudicate the disputes between the parties.

In view of the same, the learned counsel for the petitioner does not seek to pursue the present petition with liberty to raise all objections including the challenge as to the independence of the arbitrator, if any, before the arbitrator. Needless to mention that the arbitrator would be required to make the necessary disclosure under Section 12 of the Act and all rights and contentions of the parties are reserved. The petition is disposed of.
