The petitioner has filed the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking quashing of FIR No. 411/2021 dated 09.08.2021, registered under Section 304A of the Indian Penal Code, 1860, ["IPC"], at Police Station Janakpuri, District West, Delhi, alongwith all consequential proceedings emanating therefrom.

Mr. Akash Mehta, learned counsel for the petitioner, submits that charges have been framed by the Court of Judicial Magistrate First Class, Dwarka Courts, District South West, Delhi, ["Magistrate's Court"] against the petitioner, under Section 304A of the IPC, and the matter is presently at the stage of prosecution evidence. disposal of the proceedings by the Magistrate's Court. 3.

Ms. Manjeet Arya, learned Additional Public Prosecutor, appearing on advance notice, assures the Court that the prosecution shall cooperate in the expeditious recording of evidence of the remaining six witnesses, all of whom are official witnesses.

In view of the above, the present petition is disposed of, with liberty to the petitioner to move an appropriate application before the Magistrate's Court seeking expeditious disposal of the proceedings. The Magistrate's Court is requested to consider such a request, having regard to its docket and the age of the matters pending before it. 5.

The pending application also stands disposed of. 6.

It is made clear that this Court has not expressed any opinion on the merits of the case.
