Learned counsel for the petitioners states that the entire cheque amount has been paid to the respondent and that he shall be filing an application before the trial court in terms of the decision in Damodar S. Prabhu v. Sayed Babalal H. reported as (2010) 5 SCC 663. Consequently, he seeks leave to withdraw the present petition. 2.

Leave and liberty, as prayed for, are granted. The petition is disposed of in the above terms.
