Applicant along with three others are facing trial for committing culpable homicide not amounting to murder.

Charges have already been framed and the next date before the learned Trial Court is stated to be 22.05.2026 for recording of evidence of Anita and Vimla Devi. They both are stated to be eyewitnesses of the incident in question.

Learned Addl. P.P. for State, who appears on advance notice, draws the attention of the Court towards the supplementary statement of Anita which was recorded by the police on 21.07.2024 wherein she identified all the four accused, including applicant herein.

even he has not yet entered into witness box. 5.

After hearing arguments for some time, learned counsel for applicant does not press the present application at this juncture. He, however, seeks liberty to file the application afresh once alleged eyewitnesses are examined by the prosecution. He, however, prays that prosecution be directed to secure the presence of the eyewitnesses as according to him, it is a false case and he was never at the spot and the identification is also not in consonance with the established procedure.

Application is accordingly disposed of as not pressed. 7.

Liberty, as prayed, is granted.

Learned Addl. P.P. for State would send requisite instructions to her counterpart in District Courts so that there is no delay in securing attendance of eyewitnesses for recording of their evidence.
