Mr. Paul Kr. Kalai, Advocate states that he has been instructed by the arguing counsel, Ms. Kawalpreet Kaur to withdraw the present matter with liberty to file appropriate proceedings.

In the impugned order, the learned Single Judge has recorded that the appellant and her deceased husband were not dependant on Shri Ashok Gupta financially, despite the fact that they were living free of cost on his land.

The learned Single Judge has also held that it is possible that the Petitioner's husband had filed the complaint at the behest of unscrupulous land mafia in order to grab the land in which he and his wife, were living for the past 23 years.

On the last date of hearing, this Court had directed the SHO of the concerned area to file a report.

Today, Mr. Malik states that he has received a copy of the report from the concerned SHO late last night. He states that according to the report, the appellant is a house wife who does not work anywhere. He states that the two sons of the appellant (Pankaj and Sonu) are gainfully employed as drivers.

Keeping in view the finding of the learned Single Judge as well as the report of the SHO, the prayer for withdrawal with liberty is rejected and the present appeal is dismissed as being bereft of merit.
