W.P.(CRL) 1127/2026 By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks a direction to the respondent/State to consider and decide his Representation dated 23.02.2026 and transfer him to open prison in accordance with the Delhi Prison Rules, 2018.

A copy of the Representation dated 23.02.2026 is appended to the petition.

The petitioner is presently lodged in semi-open prison. Issue notice.

Mr. Sanjeev Bhandari, learned ASC is present on behalf of the State on advance copy; accepts notice; and submits that the jail authorities would decide the petitioner's representation dated 23.02.2026 within 04 weeks in accordance with the Delhi Prison Rules, 2018. The petition is accordingly disposed-of with liberty to the petitioner to file afresh for the same relief if his grievance survives. Pending applications, if any, also stands disposed-of. A copy of this order be sent to the concerned Jail Superintendent forthwith.
