% 12.03.2019 CRL.M.A. 5292/2019 Allowed subject to all just exceptions.

BAIL APPLN. 625/2019 Petitioner seeks pre-arrest bail in FIR No. 499/2018, under Sections 406/34 IPC, registered at police station Bindapur, Delhi while claiming to be innocent.

Upon notice, learned Additional Public Prosecutor for respondentState submits that petitioner is required to join investigation. Petitioner's counsel submits that petitioner is ready to join investigation as and when called.

Counsel for petitioner submits that petitioner would be appearing BAIL APPLN. 625/2019

before the Investigating Officer on 16th March at 10:00 a.m. and thereafter as and when called. He further submits that petitioner will also appear before trial court on 23rd April, 2019 and furnish an undertaking by way of affidavit to the effect that he will not create any third party interest in respect of car, which is owned by him and that he will furnish his current and permanent address to the trial court at the time of submission of bail bond/surety bond.

Let it be so done.

Outcome of investigation be placed on record by way of status report.

List on 23rd July, 2019.

Till then, subject to petitioner joining investigation and appearing before the trial court and furnishing of undertaking/ bail bond etc., he be not arrested in this case.
