% 06.02.2018 The status report has been filed by the State. The address stands verified. Learned counsel for the State points out that the petitioner is a convict in three cases and he is also under trial in one more case; this should be borne in mind while considering the prayer made by the petitioner. The petitioner is seeking parole for a period of four weeks to file an SLP against the dismissal of his appeal which was decided by this court on 19.09.2017. The petitioner was a convict under Section 302 r/w S. 34 IPC and had been sentenced to imprisonment for life. The appeal disposed of by this Court had reduced his sentence from life imprisonment to 71⁄2 years. As on 11.01.2018, as is reflected from the nominal roll, the petitioner had undergone incarceration for 6 years which includes the remission

earned by him. His jail conduct is satisfactory. This is a fit case where the petitioner should be granted the prayer made by him. Accordingly, petitioner is admitted to parole for a period of four weeks to be counted from the date of his release on furnishing of his personal bond in the sum of Rs 20,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent with condition that he shall appear before the concerned SHO on every Monday of every week. He shall also furnish his latest residential address and mobile number to the concerned investigating officer. Apart from the aforenoted conditions, he shall also not in any manner approach/contact the witnesses in which he is under trial i.e., FIR No. 449/2006 registered at PS C.R. Park.

Petition disposed of in the above terms.

A copy of this order be sent to the Jail Superintendant concerned for intimation to the petitioner.
