% 25.03.2019 The learned senior counsel, on instructions, submitted that on account of some communication gap the petitioner's counsel could not make submissions on the question of charge before the trial court on 18.03.2019. He submits that he may be permitted to withdraw the present petition, the petitioner reserving the right to raise all the contentions qua the charge before the trial court and after decision is rendered on that issue to apply afresh for bail before the said court. He submitted that the matter has since been adjourned to 30th May, 2019, which is too distant and, therefore, he may be given liberty to move the court of Additional Chief Metropolitan Magistrate for pre-ponement of case for hearing on the question of charge at an early date.

BAIL APPLN. 638/2019

The bail application is disposed of as withdrawn. The petitioner will have the liberty to apply afresh for bail after the decision is rendered on the question of charge by the concerned court. He also has the liberty to move the application before that court for early hearing which, of course, shall be considered on its merits. Dasti under the signature of Court Master.
