In terms with last order, an affidavit dated 14.02.2024 of respondent was filed, specifically testifying that till date he has not been paid a single penny towards use and occupation charges. That certainly calls for vacating the stay on operation of the impugned eviction order. However, on last date also none appeared for petitioner and same is the status today as well even in this post lunch session (it is 03:00 pm).

Therefore the petition as well as the pending applications are dismissed in default. To clarify, the respondent is at liberty to seek execution of the impugned eviction order. As requested, copy of this order be given dasti to counsel for respondent under signature of Court Master.
