CRL.M.C. 2634/2026 & CRL.M.A. 10703/2026 (stay) By way of the present petition filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner impugns order dated 25.03.2026 passed by the learned Additional Sessions Judge-03, West District, Tis Hazari Courts, Delhi in SC No.119/2025, insofar as it directs the issuance of process under section 82 of the Code of Criminal Procedure, 1973 ('Cr.P.C.'). The petitioner further prays that the Non-Bailable Warrants issued against him pursuant to order dated 25.03.2026 be converted into bailable warrants or into a notice of appearance, thereby permitting him to appear before the learned Sessions Court on a given date.

The court has heard Mr. Rupraj Banerjee, learned counsel for the petitioner; and Mr. Akhand Pratap Singh, learned SPP appearing for the State.

After a brief hearing in the matter, and as agreed-to by Mr. Banerjee, the present petition is disposed-of with the following directions: 3.1. The petitioner shall voluntarily appear before the learned Sessions Court on 18th April 2026 at 10:00 a.m. Mr. Banerjee has furnished an undertaking on behalf of the petitioner in that regard. The undertaking is accepted.

3.2. Subject to the petitioner appearing before the learned Sessions Court as aforesaid, no further steps shall be taken against the petitioner pursuant to the process issued under section 82 of the Cr.P.C. till that date.

Petition stands disposed-of in the above terms. 5.

Pending applications, if any, also stand disposed-of. 6.

A copy of this order be forwarded to the learned Sessions Court forthwith.
