The present petition assails a Suo Motu Assessment order dated 13.02.2024 and a consequent Demand Notice dated 29.02.2024 u/s 154(1) DMC (Amendment Act), 2003 issued by Assistant Assessor & Collector, MCD.

Issue notice.

Learned counsel as aforesaid accepts notice on behalf of the respondent/MCD.

After some hearing, learned counsel for the respondent submits that in view of the pleas raised by the petitioner in the present petition, an opportunity of hearing shall be given to the petitioner and a reasoned order shall be passed, and that the aforesaid Suo Motu Assessment order shall also be duly rectified, if so warranted upon conclusion of the aforesaid exercise. It is directed accordingly.

As agreed by the parties, let an opportunity of hearing be granted to the petitioner by the concerned Joint Assessor & Collector, M.C.D within a period of one week from today, and the reasoned order be passed within 4 weeks thereafter.

Till the conclusion of the aforesaid exercise, no precipitative steps shall be taken by the respondent.

With the aforesaid directions, the present petition, alongwith all the pending application/s, stands disposed of.
