% 11.12.2017 In these matters, as noted by the Court on last date i.e. 09.10.2017, the Official Liquidator has been appointed as provisional liquidator in Co. Pet. 66/2012 on 06.01.2014. In the meantime, the respondent - company went in appeal which also has been disposed of. As proceedings under SICA had commenced, the present petition was adjourned sine die on 16.10.2015. Now, as SICA is repealed, learned counsel for the respondent prays for revival of these petitions.
Keeping in view the fact that the Provisional Liquidator has already been appointed for the respondent company in Co. Pet. No. 66/2012, no purpose is served by continuing with the present petitions. On 09.10.2017, this Court has already granted permission to the petitioner(s) to file their
claim before the Official Liquidator. Those petitioners who have not filed their claim may now do so either at this stage, within four weeks or at the stage when the appropriate advertisement is issued by the official liquidator inviting claims.
In case any contention is to be urged by the petitioner against the respondent company, liberty is also granted to the petitioner(s) to move appropriate applications in Co. Pet. No. 66/2012. Learned counsel appearing for the petitioners in Co. Pet. Nos. 567/2014 and 130/2013 state that they have already filed their claim petitions before the official liquidator.
