The Petitioner prays for the following reliefs: "i. Issue a Writ of Certiorari for quashing of the orders dated 03.07.2024 and 27.12.2024 whereby the Respondents have unjustifiably extended the suspension of the Petitioner time and again, beyond the period of 180 days; and ii. Issue a Writ of Mandamus directing the Respondents to revoke the suspension period of the Petitioner and reinstate him into service on the expiry of 180 days from the date the Petitioner was placed under suspension, i.e. w.e.f. 11.10.2023 or in the alternative disburse the enhanced subsistence allowance of 75%, in terms of FR 53, from the date it became due for review, i.e. pursuant to completion of 180 days from the day the Petitioner was placed on suspension, i.e. w.e.f. 11.10.2023 at 8% interest until the amount is realised and appoint the Inquiry Officer in terms of the CVC guidelines dated 18.01.2016 and conclude the disciplinary proceedings in a time bound manner; and" 2.

and Anti-Corruption Bureau (Vigilance Section). Furthermore, a case under the Prevention of Corruption Act, 1988 has already been registered against the Petitioner.

The allegations against the Petitioner are that he is involved in smuggling of gold at the Calicut International Airport where he was posted as the Assistant Commandant. Charge Memo against the Petitioner was issued on 07.11.2024. Thereafter, Disciplinary Proceedings had been initiated, which is stated to be pending. The Inquiry Officer was appointed on 06.05.2025. The Petitioner was placed under suspension on 11.10.2023, which has been extended from time to time. The last extension of suspension was vide order dated 23.12.2025, which is to be followed for the next 06 months, i.e., 180 days.

We have heard learned counsel representing the parties at length and, with their able assistance, perused the paper book. 5.

Learned counsel representing the Respondent, after taking instructions from the concerned authority, has undertaken to complete the Departmental Proceedings against the Petitioner within the next 06 months, provided that the Petitioner cooperates. 6.

With regard to the payment of enhanced subsistence allowance, learned counsel representing the Respondent submits that if the Petitioner makes a representation, the same shall be considered afresh by passing a reasoned order uninfluenced by the prior rejection. 7.

Keeping in view the aforesaid stand taken by the Respondent, the present Petition, along with pending applications, is disposed of and no further order is required to be passed in the present Writ Petition.
