The instant writ petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the petitioner seeking issuance of a writ of habeas corpus directing the respondent to produce his missing daughter. 2.

March, 2025 and despite attempts to locate her, he was unsuccessful. On 5th March, 2025, the petitioner approached Police Station - Nihar Vihar where a missing person report was registered under GD Entry No. 28A. 3.

On 6th March, 2025, a businessman in petitioner's neighbourhood informed him that his daughter had married one Mr. Atal and showed him a document purportedly confirming that the petitioner's daughter was married. The said businessman also facilitated a phone call between the petitioner and his daughter, however, the petitioner remained skeptical about the identity of the person on call.

Thereafter, the petitioner filed the present petition expressing concerns about the safety and well-being of his missing daughter, alleging that she has been taken against her will and that the police had failed to take appropriate action.

During the hearing, Mr. Lao, learned Standing Counsel for the State, submitted that the missing girl had been located and was residing in Bikaner, Rajasthan, where she was married to Mr. Atal. 6.

To verify this, the Investigating Officer from Police Station - Nihal Vihar facilitated a video call with the petitioner's daughter during the court proceedings via which the girl confirmed that she was married to Mr. Atal, living in Bikaner and was safe. The petitioner has also spoken with his daughter.

Learned counsel for the petitioner submitted that at this stage, nothing remains for further adjudication, as the petitioner has now been able to establish contact with his daughter and her well-being has been confirmed. Therefore, it is prayed that the instant petition may be disposed of. 8.
