By virtue of the present bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the applicant once again seeks grant of interim bail in FIR No.62/2021 registered under Sections 302/323/506/201/34 of the Indian Penal Code, 1860 (IPC) at PS: Anand Parbat, Delhi after having been granted an interim bail for a period of two weeks for the very same reasons by this Court vide order dated 06.01.2026 in BAIL APPLN.5044/2025.

Learned APP for the State accepts notice. getting her due surgery done, however, the same could not be executed. In fact, the brother of the applicant is available for assisting/ supervising the surgery of their mother. Thus, the present application is liable le to be dismissed.

At the outset, it is observed that pursuant to order dated 06.01.2026 the applicant was released on bail on 13.01.2026 and as per the Medical Report, i.e., "INITIAL ASSESSMENT/FOLLOW-UP" dated 27.01.2026 issued by Dr. Ram Manohar Lohia Hospital, New Delhi which reveals that the date of admission was given as 13.04.2026 and the date of discharge was 15.04.2026, however, the same was only "subject to fitness". Despite being aware of the same, the applicant never surrendered and ended up availing the complete period of two weeks granted to him by virtue of order dated 06.01.2026.

Thereafter, the applicant also moved an application seeking interim bail before the learned Trial Court, which, was also dismissed by a well reasoned order on 02.04.2026.

Considering that there is/ are there are no change(s) in circumstances, as also that the applicant did not surrender before time and availed the total period of two weeks despite his mother not undergoing surgery as also since the applicant has a brother capable of looking after their mother, the present application, alongwith the pending application, is dismissed.
