The Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') (old Section 482 of the Code of Criminal Procedure, 1973) has been filed on behalf of the Petitioners, seeking to quash the FIR No. 0177/2025, under Sections 115(2)/74/79/351(3)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as „B.N.S.‟) The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The perusal of the FIR shows that on 05.03.2025, inter se fight took place between the Complainant and the Petitioners, who lived in the neighbourhood. The only allegation made in the Complaint is that during the fight, the clothes of the mother got torn as she intervened to save the Complainant. There were also threats extended by the Petitioners. 7.

From the allegations made in the Complaint, it is essentially a neighbourhood dispute, which was escalated and resulted in the Registration of an FIR.

It is submitted that on the Complaint of the Respondent No. 2, an FIR 0177/2025, under Sections 115(2)/74/79/351(3)/3(5) of the B.N.S., has been registered at Police Station Jaitpur, New Delhi. 9.

It is stated that with the efforts of common friends, relatives and wellwishers, both the Petitioners and the Respondent Nos. 2 and 3 have amicably settled all the disputes and differences between them and arrived at Settlement Deed dated 10.03.2025, wherein it was inter alia settled between the parties that the Petitioners shall file an appropriate Petition for quashing of the aforesaid FIR and the Respondent Nos. 2 and 3 shall co-operate in quashing of the FIR. It was also settled that in future both the parties shall maintain peace and harmony and shall live in friendly relation and either party shall have no grievance against each other. 10.

The parties are present before this Court in-person today, and have been identified by their Counsel and Investigating Officer concerned and undertake to remain bound by the terms of the Settlement. The parties have endorsed the amicable Settlement and accepted the terms thereof voluntarily. The statement of the parties, have already been recorded before the learned Joint Registrar.

The parties have submitted that all the disputes have been amicably settled vide Settlement Deed dated 10.03.2025 and thus, no fruitful purpose will be served in continuing with the abovesaid FIR. 13.

The present Petition has been signed by all the Petitioners and is supported by their respective Affidavits. The parties have reaffirmed the terms of the Settlement arrived at vide Settlement Deed dated 10.03.2025 and they also submit that the said Settlement Deed dated 10.03.2025 has been arrived at between the parties without any pressure and coercion. 14.

Today, the Respondent Nos. 2 and 3, who are present in the Court, state that they have no objection if the abovesaid FIR is quashed. 15.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion, no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, the FIR No.
