Applicant seeks regular bail in case FIR No. 262/2025 dated 21.09.2025, registered at Police Station Kishan Garh, Delhi for commission of offences under Sections 20/29 of Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 33 of Delhi Excise Act, 2009. 2.
According to learned counsel for applicant, the recovery at the instance of applicant is of 482 grams of ganja and he submits that even if the prosecution case is believed in toto, the total quantity of ganja recovered in the present matter is 17.928 kgs, which is less than commercial quantity and that he cannot be held vicariously liable for the recovery effected from his co-accused. He also submits that his co-accused are already on bail. He, thus, submit that the applicant deserves concession of bail and moreover, he has no prior involvement of any nature whatsoever.

The Nominal Roll of the applicant has been received which indicates that the age of the applicant is 35 years and he is in custody for around seven months and he has no other involvement in any other case. 5.
As already noticed above, even if the entire quantity of ganja is taken together, it is less than commercial quantity. 6.
The next date of hearing before the learned Trial Court is stated to be 17.07.2026 for arguments on charge.

Keeping in mind the overall facts of the case and fact that the other co-accused are already on regular bail, the applicant is, hereby, directed to be released on bail on the same conditions as were imposed upon his co-accused-Sushant vide order dated 26.12.2025 passed by learned Trial Court.

Applications stand disposed of in aforesaid terms. 9.

A copy of this Order be immediately sent to the learned Trial Court and Jail Superintendent for information and necessary compliance. 11.
