% 15.03.2019 The present petition has been filed under Article 226 of the Constitution of India read with Section 482 Cr.PC for issuance of writ in the nature of certiorari directing the respondent to extend the period of parole by three months on the ground of surgery of his father. Learned counsel for the petitioner submits that the father of the petitioner is suffering from cancer and he has been advised for Surgery which was scheduled for 19.02.2019 but due to some medical complication the same was rescheduled for 15.03.2019 and now for 18.03.2019. He further submits that the petitioner has already been granted parole for four weeks which period is expiring on 17.03.2019. Status report has been filed by the State.
The status report filed by the State goes to show that the factum of surgery of Mr. Moharam Ali, father of the petitioner has been verified from
Dr. Shuaib Zaidi, MS, DNB MCh. (Surgical Oncology), Apollo Cancer, who confirmed that the scheduled date of surgery is 18.03.2019 but the patient Moharam Ali has not been admitted in the hospital. Keeping in view the facts and circumstances of the present case, the present petition is allowed and the period of parole of the petitioner is further extended for a period of two weeks subject to the same conditions as laid in the order dated 14.02.2019 passed in W. P. (Crl.) 123/2019. Dasti under the signatures of the Court Master. A copy of this order be communicated to the Jail Superintendant. Petition stands disposed of.
