O R D E R

% 13.03.2019 Vide the present petition, the petitioner seeks direction thereby directing the respondents to appoint the petitioner against the existing vacancy of MIS specialist on contract basis till completion of the World Bank approved NCRMP-II Project, wherein posts are duly sanctioned by the World Bank and the post of MIS specialist is mandatory in nature. It is not in dispute that petitioner worked till 20.12.2018 and as per his appointment, he completed three years of tenure. Thereafter, the services of the petitioner is no more continued with the respondents. The case of the petitioner is that since the vacancies are existing of MIS specialist on contract basis and the World Bank Project is not completed, therefore, the respondents may be directed to fill up the vacancy by appointing the petitioner.

The fact remains that recently vide notification dated 09.11.2018,

advertisement 1-11/2018-PMU has been published. However, the post of MIS specialist has not been advertised. The learned standing counsel for the respondents, who appeared on advance notice, submits that let the petitioner wait till the MIS specialist vacancies are advertised and if advertised, the petitioner is at liberty to apply the same and if found eligible, he may be selected accordingly.

Keeping in view the fact that though the vacancies are there, but no advertisement is published for the post of MIS specialist, therefore, I find no merit in the present petition and the same is accordingly dismissed.
