Petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner with the following prayers: "(a) Pass appropriate Writ(s)/Order(s)/Direction(s) particularly in the nature of mandamus to the Respondent No. 1 to 5 whereby directing them to carry out proper and further investigation into the offences committed/committing by the Respondent No. 6 to 12 who are in connivance and collusion with each other are trying to grab the property measuring 200 Sq. Y ds. Plot No. 86, R.S. Block (New No.352-A), Gali No. 9, Bhola Nath Nagar, Delhi-110032 vide Khewat No. 1, Khasra No. 1517/624, Village Chandrawali@ Shahdara, Tehsil Vivek Vihar measuring 4 Biswas i.e. 200 Sq. Y ds.

(b) Pass further appropriate Writ(s)/Order(s)/Direction(s) particularly in the nature of mandamus whereby passing direction to transfer the investigation of the incidents as mentioned in the complaints of the Petitioners to C.B.I., S.I.T. and/or any other Independent Investigating Agency with directions to them to carry out the investigation into the said complaints of the Petitioners.

(c) Pass further appropriate Writ(s)/Order(s)/Direction(s) particularly in the nature of mandamus to the Respondent No. 1 to 5 whereby directing them to provide the adequate security and safety to the Petitioners at the hands of the Respondent No.6 to 12." 2.

Learned ASC for the State appears on advance notice and submits that disputes prima facie appear to be of civil nature in respect of which a complaint dated 27.02.2024 has been received by Investigating Officer only on 15.03.2024. He further informs that an earlier complaint regarding unauthorized construction over the disputed plot was received and same was forwarded to the concerned Municipal Authorities for purpose of necessary action.

Learned ASC for the State states that necessary action shall be taken on the complaint dated 27.02.2024 in accordance with law, and the petitioner shall be accordingly informed.

Taking the statement of learned ASC for the State on record, petition is accordingly disposed of. Pending applications, if any, also stand disposed of.
