Counsel for the Petitioner states that since the material witnesses have already been examined before the Trial Court in the present matter, he seeks the leave of this Court to withdraw the present application, with a liberty to approach the Trial Court.

Leave and liberty as aforesaid granted.

It is, however, clarified that in the event the Petitioner applies for regular bail before the Trial Court, the said Court shall consider whether there are indeed any change in material circumstances, and then proceed to decide the petition, on its own merits, in accordance with law. 4.

Dismissed as withdrawn, with liberty as aforesaid. 5.

It is made clear that the Court has not commented on the merits of the case and all rights and contentions of the parties are left open.
