% 19.07.2016 CM No. 25193/2016 This is an application moved by the parties to record a compromise. Counsels for the parties are present. The parties have settled their disputes. The settlement is in terms of the agreement dated 15.07.2016 entered into by both the parties under the aegis of Delhi High Court Mediation and Conciliation Centre. Mr. Sapan Aggarwal, the respondent, undertook to pay Rs. 1,00,00,000/- (Rupees One Crore Only) to the appellant, Ms. Neelima Aggarwal. The amounts were agreed to be paid under following terms:- i) Rs. 30,00,000/- in the name of the First Party as 'Neelima Aggarwal' by way of pay order/demand draft No. 061240 dated 11.7.2016 drawn on HDFC Bank, Chandni Chowk Branch, Delhi.
ii) Rs. 35,00,000/- in the name of the minor daughter 'Avni Aggarwal' by way of pay order/demand draft No. 061239 dated 11.7.2016 drawn on HDFC Bank, Chandni Chowk Branch, Delhi.
iii) Rs. 35,00,000/- in the name of the minor daughter 'Avni Aggarwal' by way of pay order/demand draft No. 061241 dated 11.7.2016 drawn on HDFC Bank, Chandni Chowk Branch, Delhi.
The respondent has today tendered the said amounts by way of the demand drafts, mentioned in the settlement agreement. She is present in court and confirms that the agreement was entered into by her voluntarily.
The counsels for the parties submit that the appeal should be disposed of as withdrawn.
Accordingly, the agreement entered into by the parties on 15.07.2016 is hereby taken on the record.
In view of the above settlement, CM No. 25193/2016 is allowed and FAO No. 70/2013 is dismissed as withdrawn. Date already fixed i.e. 28.07.2016 stands cancelled. S. RAVINDRA BHAT, J DEEPA SHARMA, J JULY 19, 2016 sapna
