The petitioner, having been granted NOC and pursuant thereto having been discharged from employment with the Air Force as an Airman, after 10 years of service, but before expiry of 15 years of service making the petitioner eligible for pension, states that the case of the petitioner is covered by the dicta of this Court in Govind Kumar Srivastava v. Union of India MANU/DE/0048/2019 and order dated 15th January, 2020 in W.P.(C) 9524/2019 titled Rakesh Kumar v. Union of India and the petitioner is entitled to pro rata pension.

Accordingly, the petition is disposed of directing the respondents to grant to the petitioner, upon verification, pro rata pension, from the date he was discharged from service, with arrears being paid to the petitioner not later than 12 weeks from today, failing which the respondents shall be liable to pay simple interest @ 6 % p.a. on the said amount for the period of delay. 6.
