The present petition has been filed under Section 11 of the Arbitration and Conciliation Act, 1996, seeking the appointment of an Arbitrator to adjudicate the disputes that have arisen inter se the Petitioner, the Delhi Metro Rail Corporation- Respondent No. 1 and Ayush Services & Consultancy- Respondent No.2. 2.

A perusal of the Agreement upon which reliance has been placed to show the dispute resolution clause is one which has been entered into between the Respondent Nos. 1 and 2. 3.

This Court is of the opinion that in the light of the same, there is no arbitration Agreement as between the Petitioner and Respondent No. 1.

take such steps as are available to him under the law, he has invited the Court to pass an order.

In view thereof, this Court is of the opinion that the present Petition is not maintainable since there exists no arbitration Agreement between the Petitioner and Respondent No.1. 6.
