An Appeal under Section 96 CPC has been filed against the Judgment and Order dated 21.02.2026 in CS 133/2025 whereby the Suit for Possession under Order XII Rule 6 CPC has been decreed against the Appellant. 2.

Learned counsels for the parties on instructions submit that the matter has been amicably settled. The Appellant/Tenant undertakes to hand over the physical peaceful vacant possession to the Respondent/Landlord on or before 31.08.2026. It is further agreed between the parties that the Appellant shall pay the Occupation Charges @ Rs.1 lakhs per month though they would be subject to the final outcome of the Judgment of the Trial Court, where Mesne Profits are pending for adjudication. 3.

It is further agreed that the Appellant shall continue to pay the water and electricity charges in terms of the earlier arrangement from 18 the May, 2026 till the date of handing over the Possession. 4.

which they have entered into voluntarily without any pressure, force or coercion.

Learned counsel submit that the undertaking of the Appellant in person and of the Respondent shall be filed before the Registrar within seven days.

It is hereby clarified that the payment of Rent/Occupation Charges under this Compromise are not final adjudication and are subject to the final outcome of the proceedings before the learned Trial Court. It is also clarified that whatever amount is paid it would be without prejudice to the rights and contentions of the parties.

The Appeal stands disposed of accordingly along with the pending Applications.
